Terms and conditions

These conditions govern the use of the forms on this website and set out the general framework for contracting the services of JOB AND SKILLED, S.L.. What is agreed in the quotation or contract signed for each project always prevails.

1. Nature of the services

JOB AND SKILLED, S.L. provides construction, installation, refurbishment, maintenance and specialist subcontracting services, in accordance with Ley 32/2006, of 18 October, governing subcontracting in the construction sector (Spain's construction subcontracting act).

We are not a temporary work agency (ETT). We do not supply workers to be directed by the client company. Our staff are registered as employees of JOB AND SKILLED, S.L. and carry out their work under our organisation, direction and with our resources.

2. Enquiries and quotations

  • Submitting a form constitutes a request for information or for a proposal, and creates no contractual obligation for either party.
  • Quotations are issued in writing, setting out scope, price, timescale and conditions, and are valid for the period stated in them.
  • The contract is formed when the client accepts the quotation in writing.
  • Prices are stated excluding IVA (Spanish VAT) unless otherwise indicated, and the rate in force will be applied.

3. Carrying out the work

  • The client will provide access to the site, the necessary services and supplies, and the coordinación de actividades empresariales information (the statutory health and safety coordination between the companies working on a site) that is required.
  • JOB AND SKILLED, S.L. will provide staff who are registered as employees, with PRL training (occupational risk prevention) and personal protective equipment appropriate to the work.
  • The timescales indicated are estimates and may be adjusted for reasons not attributable to JOB AND SKILLED, S.L., including delays by other trades, lack of materials or access conditions.
  • Any extension of the agreed scope will be documented and quoted separately before it is carried out.

4. Time records and invoicing

  • Where the service is invoiced by the hour, the basis will be the digital working-time record, which the client can consult through the portal.
  • Corrections to a clocking entry are logged, recording who requested and who approved them; the original record is not deleted.
  • Payment terms will be those stated in the quotation. Failing that, Ley 3/2004, on combating late payment in commercial transactions (Spain's late payment act), will apply.

5. Client portal

  • Access to the portal is personal and non-transferable. The client is responsible for safeguarding its credentials.
  • The information published on the portal is intended for project monitoring and does not replace the contractual documentation.
  • JOB AND SKILLED, S.L. may suspend access in the event of misuse or for security reasons, informing the client accordingly.

6. Warranties and liability

  • Work carried out is subject to the applicable statutory warranties, in particular those provided for in Ley 38/1999 de Ordenación de la Edificación (Spain's building act, LOE) where it applies.
  • Damage arising from improper use, lack of maintenance or the actions of third parties on the completed work is excluded from the warranty.
  • Save in cases of wilful misconduct or gross negligence, the liability of JOB AND SKILLED, S.L. is limited to the value of the service contracted, without prejudice to the cover provided by its public liability insurance.

7. Cancellation

Cancellation of a service already accepted must be notified in writing with the reasonable notice agreed. Work already carried out and costs already committed up to the date of cancellation will be invoiced.

8. Data protection

The processing of personal data is governed by the privacy policy. Where the service involves access to data for which the client is the controller, the corresponding data processing agreement will be signed in accordance with article 28 of Regulation (EU) 2016/679 (GDPR).

9. Applicable law

These conditions are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of the registered address of JOB AND SKILLED, S.L., unless a mandatory rule provides otherwise.

10. Governing version

This translation is provided for convenience. In the event of any discrepancy between language versions, the Spanish version of this document prevails.
